This information notice has been prepared to inform you pursuant to the Law on the Protection of Personal Data No. 6698. Your personal data that you have notified to our Company or that have been obtained by our Company through various channels for the purpose of receiving investment fund trading, portfolio management, and investment consultancy services from Albaraka Portfolio Management Joint Stock Company are processed by our Company in the capacity of “Data Controller” within the scope of the Law on the Protection of Personal Data.

Your personal data are processed within the scope of the personal data processing conditions and purposes specified in Law No. 6698, in connection with Investment Fund Trading, Portfolio Management, Investment Consultancy, and other Capital Markets activities under the Scope of Fund Distribution, for purposes such as carrying out the necessary work by our business units to enable you to benefit from the products and services offered by our Company, customizing and recommending the offered products and services according to your preferences, usage habits, and needs, being able to communicate with you regarding the products and services you have received/will receive, and, provided that you have given permission in this regard, using them in marketing activities, product/service offers, modeling, intelligence, reporting, scoring, risk monitoring, determining and implementing our Company’s commercial and business strategies, current or new product studies of our Company and the companies in which we have shareholdings, and identifying potential customers.

Your personal data may be transferred, due to legal obligations and within the framework of legal limitations, to administrative and official authorities to which transfer is legally required, our Company’s direct and indirect shareholders and their affiliates, our business partners, suppliers, persons related within the scope of intermediary activities, independent audit companies in cases permitted by the legislation, institutions authorized to receive information pursuant to the Capital Markets Law, electronic environments and platforms used for Capital Markets activities, and legal entities such as the Capital Markets Board (CMB), Borsa İstanbul A.Ş. (BIST), Turkish Capital Markets Association (TSPB), Central Registry Agency Inc. (MKK A.Ş.), and the Central Bank of the Republic of Türkiye (CBRT). For the stated purposes, your personal data are processed due to investment services and activities, tax, MASAK, SSI legislation, and other legislation related to the Capital Markets Law. Your personal data are collected through methods such as applications made via our Head Office, customer meetings, the Identity and Address Sharing System, SMS and e-mail channels, applications made through websites, social media, applications made to sales teams, companies from which call center services are obtained, and other channels through which our Company has contacted or may contact its customers in the future, and are stored within the statutory periods in accordance with the relevant legislation.

In addition, in line with your explicit consent, your personal data such as name, surname, e-mail address, phone number, and, if you participate in online meetings, visual and audio personal data are shared with Google Drive, which is based in the United States of America and from which server and cloud services are obtained. Communication may also be established with you via the WhatsApp application in line with your explicit consent. In this case, all communications conducted via WhatsApp are stored in encrypted form by WhatsApp on WhatsApp’s servers located abroad. The corporate e-mail network to be used operates on Google and other programs located abroad. In this case, all e-mail communications you conduct via your workplace e-mail address are stored in encrypted form on Google’s servers located abroad.

All these sharing and storage processes are carried out based on your explicit consent obtained clearly via the website pursuant to Article 9/1 of the Law on the Protection of Personal Data. You may withdraw your explicit consent regarding the transfer of your personal data abroad at any time. Withdrawal of your consent will not affect the lawfulness of the processing carried out based on your consent prior to such withdrawal.

Within the scope of data transfer abroad, Google, WhatsApp, and relevant social media platforms process your personal data as independent data controllers within the framework of their own privacy policies and data security standards.

Without prejudice to all relevant exceptions, primarily those stipulated in Article 28 of the Law on the Protection of Personal Data, pursuant to Article 11 of the Law on the Protection of Personal Data, you have the right to learn whether your personal data are processed, to request information if your personal data have been processed, to learn the purpose of processing of your personal data and whether they are used in accordance with this purpose, to know the third parties to whom your personal data are transferred domestically or abroad, to request correction of your personal data if they have been processed incorrectly, to request deletion or destruction of your personal data if the reasons requiring their processing cease to exist, to request notification of the correction or deletion processes to third parties to whom your personal data have been transferred, to object to the occurrence of a result against you by analyzing the processed data exclusively through automated systems, and to request compensation for damages in case you suffer damage due to unlawful processing of your personal data.
